Partner Success Core Benefits: can Windows Server licences run on a dedicated server rented from a hosting provider?

We are a Partner Success Core Benefits member and receive Windows Server 2025 licences (Standard and Datacenter, 16 core licences each) for our own internal development and lab servers.

We are thinking about moving these servers to a dedicated server rented from a hosting provider (used by us only, running Hyper-V). We could not find a clear answer in the Terms of Participation Guide on whether the benefit licences may be used on hosted hardware.

Has anyone been in the same situation, or does anyone know where we could get an official answer (a Microsoft contact, a licensing partner)? If you know of a clause that applies, a pointer would be much appreciated. Thank you!

    Hello Aleksandar,

Thank you for posting question on Microsoft Windows Forum!

Based on your query of whether Windows Server licenses can run on a dedicated server rented from a hosting provider. Well! Under the terms of the Microsoft AI Cloud Partner Program (MAICPP) and the Terms of Participation Guide, software licenses received as core benefits (such as Windows Server Datacenter/Standard granted via Partner Success Core Benefits) are strictly intended for the partner’s internal business use, testing, and development.

Internal Use Rights (IUR) / core partner benefit software must be installed on hardware that is owned or leased and under the day-to-day operational control of the partner organization itself. When you move workloads to a "dedicated server rented from a hosting provider," compliance depends entirely on how that hosting arrangement is structured. For multitenant public clouds or shared IaaS. You generally cannot use internal-use partner license grants here unless covered by specific cloud provider exceptions, because you do not have exclusive physical hardware control, and partner software benefit terms restrict arbitrary cloud deployment. On the other hand, for dedicated hosting or bare-metal dedicated servers. If you rent a dedicated physical server where the hosting provider gives you exclusive single-tenant physical hardware access, it may look like "your own" server, but Microsoft’s licensing clauses scrutinize who manages the underlying physical host. If the host hardware is managed by the external provider as part of a hosted service, standard partner software grants often prohibit deployment unless covered under specific outsourcing rules (such as Authorized Outsourcer terms or the Flexible Virtualization benefit). However, partner internal use software grants typically do not inherit commercial Software Assurance "Flexible Virtualization" rights by default unless explicitly stated in the Product Terms for internal-use software.

Since you have Partner Success Core Benefits, you also have Partner Concierge access. You can sign in to your Partner Center Dashboard. Navigate to Support > Help + support and open a ticket regarding Membership / Internal Use Software Benefits. This places your inquiry directly with Microsoft’s internal partner operations team.

Otherwise, if your organization works with an enterprise software advisor or a distributor, reach out to their specialized Microsoft licensing specialists. They deal with hosting compliance and partner benefit mapping daily and can pull the exact policy documentation for dedicated host deployments.

You can consult the following articles for further reference regarding your concerns.

Hope the above information is helpful!
